These rules do not supersede any provisions that have been specifically agreed with any of clients, partner and/or providers.

For purposes of this Notice, You and/or Client and/or Patient and/or User are indistinctively used to mean the owner of the personal data.
By providing us with your personal data you acknowledge and declare that:

• You are above 18 years old
• You understand the English language
• You authorize the collection, processing and use of the personal data in the terms contained herein.

a) Identification of company responsible for the processing

b) Purposes of the processing of the personal data

Fairway provides premium promotion and facilitation medical tourism services in Portuguese private health units, under the trademark Medical Port®.

Fairway services include the facilitation, intermediation and support services related to medical travel processes (but do not include the provision of the medical services). 

For this, Fairway needs to collect personal and health information for the purposes of:

• Submit a proposal and provide the proposed medical travel services to Client
• Send to client marketing information on other services that Fairway may develop in the future and that it believes are of interest of client, provided client has given its consent and has not opted out.

c) Identification of categories of data that will be collected

Personal data for proposal elaboration: 

Name, email, telephone number for contact, identification of the desired medical procedure, age, gender, local medical doctor and place where he/she can be contacted (if applicable), nationality, insurance company and policy number (if applicable), IBAN for reimbursement purposes (if applicable). 

Health data:

Information related to the medical procedure that client wish to acquire, therapeutic, instructions from the doctor that prescribed such intervention (if applicable), other therapeutic that client is taking and that may influence the medical procedure that is being acquired, Fairway collects your data after your specific consent by telephone, email or through a form in our website.

Failure to provide such obligatory information will result in Fairway being unable to send a quote and/or proposal and/or not provide the medical tourism services, whichever applicable. We will maintain your data for the time strictly necessary for the completion of each of the purposes mentioned above or for further legitimate purposes or for the period authorized by the National Data Protection Authority (CNPD). Notwithstanding the above, Fairway may retain some categories of data for a longer period for compliance with legal requirements.

d) Recipients or categories of recipients of such data

• Hospitals – data will be communicated to the hospital that will be performing the elected medical procedure.
• Travel Agency – only personal data is communicated for purpose of provision of the touristic services associated to the medical travel package.

These third parties are bound, through signature of a written contract with Fairway, to maintain confidentiality on the data received and to adopt the technical and organizational measures adequate to protect personal data against unauthorized access or use, change, unlawful or accidental destruction and accidental loss, in those instances where they will act as data processors for such information.

The data to be transmitted to these 3rd parties is on a need to know basis a restricted to minimum necessary to allow them to provide such services.

Fairway may also have to communicate personal data to authorities and regulatory bodies, such as tax and social security authorities, for purposes of compliance with relevant local and regulatory laws.

e) Right of access to and right to rectify your personal information

• You have the right to access, rectify and delete your personal information at any time.
• We only will send you marketing campaigns related to our products with your permission. If you agree or submit to receive our marketing campaigns and materials, you can opt out this option anytime.

Please note that, according to the relevant law, you may access your health data only through a doctor appointed by you.

g) Safeguards to data

Fairway has adopted appropriate organizational and technical measures for the safety of the personal data and to prevent unauthorized access or use, alteration, unlawful or accidental destruction and accidental loss of such data, including but not limited to, restriction of physical and logical access to data, logical separation of personal data and health data, amongst others.

Online collection of data:

Medical Port applies the highest standards for data security in the management of customer information. We only collect your personal data if you voluntarily share it with us, for example via our website, by email, or by telephone or by submitting our newsletter. We do not sell or rent any personal information to third parties for their marketing purposes.

As provided for in the relevant laws, collection and processing of health data is conducted by a health professional subject under national law or rules established by national competent bodies to the obligation of professional secrecy or by another person also subject to an equivalent obligation of professional secrecy.

H) MEDICAL PORT NEWSLETTER

We will keep contact with costumers who subscribe the Medical Port Newsletter for marketing purposes. Therefore, we will keep these contacts on our list having access to subscribers email address, marketing status, activity and contact rating.

We assure that we only use this information to be in touch with subscribers about their subscription and to furnish updates related to our services. We guarantee that we won’t rent or sell this information to third-party entities.

The subscriber can opt out the Newsletter by clicking on the unsubscribe link in the footer of any email he or her receive from us, or by contacting the company at info@medicalport.org.

I) Cookies  - automatic collection of Data

Fairway may use cookies, web beacons or other similar files in its website in order to improve performance and enhance the User experience.

Cookies are small text files that a website may put on User’s computer or mobile device in order to recognize the device the next time the User visits the website.  It is a common practice in the internet as this enables the recognition of the User when browsing the web. For instance, when a User returns to the previous page of a website, the cookie enables him/her to come back to the selected page with the preferences that the User had previously selected.

Except in those instances where the User has disabled cookies in its browser, when User decides to continue to use Fairway’s Platform it is consenting on using the above mentioned cookies.

The navigation experience in this Site is necessarily less fulfilling if the cookies are disabled but this does not prevent user from navigating in the website.

J) Applicable laws

Medical Port are committed to safeguarding the privacy of our website visitors and registered users of the Medical Port platform. This Notice sets out how we will treat your personal data when we act as the controller of that data and when its processing is governed by the EU General Data Protection Regulation (GDPR).

K) Changes to this Notice

This Notice is effective from 25 May 2018. Fairway may from time to time make changes to this Privacy Notice to reflect any changes to our privacy practices in accordance with changes to legislation, or to the Fairway website. You will be notified through the email you have provided and/or through notice of change in this website.
